NOTICE OF PUBLIC HEARING
PROPOSED LOCAL LAW NO. 2 OF 2026 ENTITILED

“LOCAL LAW FOR FLOOD DAMAGE PREVENTION AS AUTHORIZED BY THE NEW YORK STATE CONSTITUTION, ARTICLE IX, SECTION 2, AND ENVORONMENTAL CONSERVATION LAW, ARTICLE 36”
PLEASE TAKE NOTICE, that the Town Board of the Town of Minerva, Essex County, New York, will meet at the Town Hall located at 5 Morse Memorial Hwy., Minerva, New York 12851, on the 5th day of November 2026, at 6:00 p.m. for the purposes of conducting a Public Hearing to introduce Local Law No. 2 of 2026 entitled. “Local Law for Flood Damage Prevention as Authorized by the New York State Constitution, Article IX, Section 2, and Environmental Conservation Law, Article 36”
The purpose of this Local Law is to promote the public health, safety, and general welfare, and to minimize public and private losses due to flood conditions in specific areas by provisions designed to: (i) regulate uses which are dangerous to health, safety, and property due to water or erosion hazards, or which result in damaging increases in erosion or in flood heights or velocities; (ii) require that uses vulnerable to floods, including facilities which serve such uses, be protected against flood damage at the time or initial construction; (iii) control the alteration of nature floodplains, stream channels, and natural protective barriers which are involved in the accommodation of flood waters; (iv) control filling, grading, dredging, and other development which may increase erosion or flood damages; (v) regulate construction of flood barriers which will unnaturally divert flood waters or which may increase flood hazards to other lands; and (vi) qualify and maintain for participation in the National Flood Insurance Program.
PLEASE TAKE FURTHER NOTICE, that at said Public Hearing to be held at the time and place set forth above, the Town Board will consider this Local Law and hear all parties interested therein concerning the same.
PLEASE TAKE FURTHER NOTICE, that a copy of the full text proposed Local Law No. 2 of 2026 may be obtained upon request from the Town Clerk of the Town of Minerva.
